These Terms of Use govern access to and use of the VIOM website and application. Purchases, credits, subscriptions and withdrawal are governed by the Terms of Sale.
These documents are written in English for VIOM's current international interface. An authoritative French version will be published before commercial launch in France; where French mandatory consumer law applies, it prevails over any wording below.
1. What VIOM is
VIOM is an AI-assisted software service that processes video and media files you upload. Depending on the current version of the product, VIOM can: upload and store your source file, transcribe it, analyse the transcript, detect candidate viral moments, compute an informational Viral Score, extract clips, reframe them to a vertical format, generate dynamic captions with AI-assisted emphasis, let you adjust the range and framing, render final files, and generate publishing metadata such as hooks, descriptions and hashtags.
VIOM does not publish to TikTok, Instagram or YouTube, does not import directly from those platforms, and does not manage social accounts. Any such feature would require a separate announcement and updated terms.
2. Accounts and eligibility
You must have the legal capacity to enter into a contract. VIOM is not designed for minors; accounts must be created by a person able to contract validly under the law applicable to them, and the minimum age requirement will be confirmed as part of the legal review before commercial launch.

- Provide accurate account and billing information and keep it up to date
- You are responsible for activity carried out through your account

3. Automated processing and AI — important
VIOM uses automated systems and artificial intelligence. Transcriptions, analyses, scores, clip selections, captions, titles, hooks, descriptions, hashtags and any other generated output may contain errors, omissions, misinterpretations, inaccuracies or unexpected results.
The Viral Score is an informational algorithmic estimate. It is not a promise or guarantee of views, engagement, virality, followers, revenue, conversion or platform monetisation.
You remain responsible for reviewing every output before using or publishing it. VIOM does not provide financial, legal, medical, investment or other professional advice, and does not perform editorial verification of your content.
4. Your content
You keep all ownership of the files you upload and of the outputs generated from them. VIOM acquires no ownership of your content.
You grant VIOM only the limited, non-exclusive licence needed to provide the service you request: to host, store, transmit, transcode, extract audio, segment, transcribe, analyse, temporarily reproduce and render your content, and to have this done by the providers listed in the Privacy Policy. This licence lasts only as long as needed to provide the service and to comply with our legal obligations.

5. Generated outputs
Subject to applicable law, you may use the clips, captions and texts VIOM generates for you. The legal status of AI-generated material varies between countries and is evolving: VIOM does not promise that a generated output is protected by copyright, that it is exclusive to you, or that a similar output will not be produced for someone else. Rights in the underlying source material remain governed by their own rules.
6. Acceptable use
You must not attempt to:
- Compromise the security of VIOM or of its providers
- Circumvent, manipulate or falsify the credit system
- Abuse the interfaces or APIs, or scrape protected areas
- Reverse engineer the service, except to the extent that such a prohibition is unlawful
- Introduce malware or overload the infrastructure
- Share an account abusively or evade a suspension
7. Social platforms
Before publishing anything produced with VIOM, you are responsible for checking compliance with platform terms, copyright and neighbouring rights, advertising and disclosure rules, music licences, commercial-use rights, privacy and image rights, and applicable law.
VIOM cannot guarantee that a platform will accept a clip, monetise it, keep it online, spare an account from moderation, or distribute the content to an audience.
VIOM is independent and is not endorsed by, affiliated with or sponsored by TikTok, ByteDance, Instagram, Meta, YouTube or Google. Their trademarks belong to them.
8. Availability, maintenance and changes
VIOM may be affected by maintenance, updates, provider or AI-provider outages, cloud or network incidents, processing queues and temporary unavailability of a feature. No level of uninterrupted availability is promised, and 100% uptime is not guaranteed.
We may maintain, update, secure, modify or improve the service, and temporarily suspend it where necessary. Material changes affecting consumers are notified in accordance with applicable consumer law, with the right to terminate where the law provides it.
9. Backups
VIOM is not a backup service. Keep your own copies of important original files. Retention rules are described in the Privacy Policy.
10. Suspension and termination
We may restrict, suspend or terminate access in case of security threat, fraud, payment or chargeback abuse, serious or repeated infringement, illegal use, manipulation of the credit system, technical attack or material breach of these terms. Where appropriate and legally required, we give notice, state the reasons and allow the breach to be remedied. Immediate action may be taken where necessary for security, fraud prevention, illegal activity, protection of third-party rights or legal compliance.
You may stop using VIOM and request deletion of your account at any time.
11. Liability
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including in cases of fraud, wilful misconduct, gross fault where relevant, personal injury, and mandatory legal guarantees owed to consumers.
Consumers: VIOM is liable under the conditions provided by French and EU law. No blanket cap on damages is applied to consumers.
Professional / business users: to the fullest extent permitted by law, VIOM's aggregate liability arising from the contract is limited to the amounts paid by the user for the service during the twelve months preceding the event giving rise to liability, and VIOM is not liable for indirect losses such as loss of profit, revenue, audience, opportunity or data, to the extent such exclusion is lawful.
Subject to applicable law, VIOM is not responsible for a decision to publish an unreviewed AI output, or content for which you do not hold the necessary rights.
12. Indemnification (professional users only)
Professional and business users agree to indemnify VIOM against third-party claims resulting from their unlawful content, infringement of third-party rights, fraud or material breach of these terms, subject to VIOM notifying them of the claim and allowing them to participate in its defence. This clause does not apply to consumers.
13. Force majeure
Neither party is liable for a failure to perform caused by an event beyond its reasonable control that could not reasonably be foreseen at the conclusion of the contract and whose effects cannot be avoided by appropriate measures, within the meaning of Article 1218 of the French Civil Code. If the impediment lasts, either party may terminate under the conditions provided by law.
14. Governing law and disputes
These terms are governed by French law. If you are a consumer resident in the European Union, you keep the benefit of the mandatory protections of the law of your country of residence, and you may bring proceedings before the courts of your place of residence. No exclusive jurisdiction clause is imposed on consumers.
Professional users: to the extent permitted by law, disputes fall within the exclusive jurisdiction of the competent courts of Metz, France, where the publisher is established (see the legal notice).
